A. GENERAL PURPOSE:
Performs a variety of complex, high level administrative, technical, and professional work within the municipal environment, including the prosecution of crimes, drafting of communications, court documents, contracts, ordinances, and resolutions, advising the various municipal departments and city officials as to the legal rights and obligations of the municipality and its officers and agents within the parameters of the applicable local, state, and federal laws.

Works under the supervision and guidance of the City Attorney.

Prosecuting Attorneys and Legal Secretary
D. ESSENTIAL DUTIES AND RESPONSIBILITIES:
a. Shares in the criminal prosecution duties of the city, which includes criminal and civil litigation in Municipal and District Court and appeals to the Supreme Court.
b. Assists the City Attorney in civil and criminal matters.
c. Assists in providing professional advice to the city council and department heads, makes presentations to councils, boards, commissions, civic groups, and the general public.
d. Determines work procedures, prepares work schedules, and expedites workflow, studies and standardizes procedures to improve efficiency and effectiveness of operations.
e. Issues written and oral opinions, assigns duties and examines work for exactness, neatness, and conformance to policies and procedures.
f. Maintains harmony among workers and resolves grievances.
g. Performs or assists subordinates in performing duties, provides mentorship to prosecuting attorneys
h. Prepares a variety of studies, reports, and related information for decision-making purposes.
i. Assists department directors to see that all laws and ordinances are faithfully enforced.
j. Advises city and judicial officers of legal conditions and current and future trends, issues legal opinions.
k. Attends all meetings of the administration at which attendance may be required.
l. Attends all court hearings at which attendance may be required.
m. Advises city officials of changes to state or federal laws affecting city operations in assigned area of responsibility.
n. Gathers evidence in criminal cases for prosecution.
o. Conducts research, interviews clients, and witnesses and handles other details in preparation for trial.
p. Prepares legal briefs, develops strategy, arguments, and testimony in preparation for presentation of case.
q. Represents agency in court, and before quasi-judicial or administrative agencies of government, as required.
r. Interprets laws, rulings, and regulations for city officials and staff in assigned area of responsibility.
s. Confers with colleagues with specialty in areas of law to establish and verify bases for legal proceedings, serves as a liaison between outside legal counsel and city officials on specialized legal issues.
E. MINIMUM QUALIFICATIONS:
Education and Experience:
Graduation from an accredited law school with a Juris Doctor degree in law and four (4) years of experience as a practicing attorney with a significant litigation experience, trial experience, and preferred municipal background. Must be licensed to practice law in the State of Montana.
Necessary Knowledge, Skills and Abilities:
a. Considerable knowledge of state statutes relating to criminal conduct; Considerable knowledge of municipal infractions or laws with misdemeanor or felony penalties; Working knowledge of municipal law;
b. Skill in preparing briefs and other legal documents; skill in prosecuting crimes;skill in handling
a case from inception through trial, skill in operating the listed tools and equipment;
c. Ability to prepare and analyze comprehensive legal documents; ability to carry out assigned projects to their completion; ability to communicate effectively verbally and in writing; ability to establish and maintain effective working relationships with employees, city officials, the court system, and the general public; ability to prosecute violations of the law efficiently and effectively.
F. SPECIAL REQUIREMENTS:
A license to practice law in the State of Montana; member in good standing with the Montana StateBar; valid State driver's license.
G. TOOLS AND EQUIPMENT USED:
Requires frequent use of personal computer, including word processing programs; calculator, telephone, copy machine and fax machine.
